The MMV company, as owner of its database and data controller, within the framework of its activities and in accordance with the legislation in force, namely the combined provisions of the "Information Technology and Civil Liberties" Act of 6 January 1978, as amended, relating to information technology, files and civil liberties, and the European Regulation on the protection of personal data known as the "RGDP". (or "GDPR" General Data Protection Regulation) as they exist today and as they may be modified, undertakes to ensure the protection, confidentiality and security of the personal data of the users of its services, as well as to respect their privacy.

Through this privacy policy, MMV informs you of the procedures by which MMV, its subcontractors and its possible partners process your personal data and of the conditions under which we collect your personal data and the use we make of it.

In particular, this Policy is applicable to customers and users of offers and services and to visitors to the mmv.fr sites, .mmv.fr partners, owners, recruitment and other sites managed by MMV.

1 - Who controls your personal data?

The MMV group is the owner of the database and therefore qualified as responsible for the processing of your personal data in accordance with the combined provisions of the laws and regulations in force both on the national territory and in Europe. Consequently, the control of your data is thus ensured by the MMV company, a simplified joint stock company with a capital of 4.440 M€ registered in the RCS of ANTIBES under the n°411 926 892 - 51, avenue France d'Outremer - B.P.39 - 06701 SAINT LAURENT DU VAR CEDEX.

2 - What data do we collect ?

By "personal data" we mean any data concerning you that enables us to identify you or makes you identifiable, in particular, your first and last name, your telephone number or email address, your booking number, your payment information, your identifiers and passwords required to access the website, certain data such as your height and weight in the context of ski equipment hire.

Depending on the case, MMV processes your personal data, either directly collected from you or resulting from the use of products or services.

MMV is also likely to be recipient of data that has been collected from you by a third party.

MMV processes a data or category of data only if it is strictly necessary for the purpose pursued.

MMV processes the following categories of data :

  • • Economic and financial data: means of payment, payment history…

  • • Profiles and scores for customer segmentation (history of stays, and related services booked in connection with your accommodation)
  • • Location data

Personal information relating to your health (such as allergies in the context of our catering service), suspected offences or convictions for criminal offences are considered "sensitive" personal data in accordance with applicable data protection laws. We will only process such data if you have given your explicit consent, or if necessary (e.g. if you request special assistance or in the case of food allergies in our restaurants), or if you have deliberately made such data public.

3 - When do we collect your data?

MMV only processes personal data for specified, explicit and legitimate purposes as described in point 5.

In particular, we collect such data in the following cases:

  • • when you create an account on the mmv.fr website,
  • • as part of the management of your subscription and unsubscription to our emails and marketing campaigns,
  • • when you make or modify a holiday booking with us (on the website or with our Central Booking Office) or via one of our distribution partners (either directly or indirectly through our trusted third party partners),
  • • when you use our website and/or our mobile application,
  • • when you take part in a survey (satisfaction survey in particular) or a competition (organised by MMV or a third party partner within the framework of co-registration),
  • • when you contact us by email, phone, online chat or social network

4 - Who can consult your data? Who are the recipients of your data?

The data collected are intended for MMV's internal services and its subcontractors.

The data may also be processed by MMV's partners. These are situations where partners are involved in the provision of services. It can also be processing to which you are offered to consent. Finally, the processed data may be transmitted to the competent authorities, at their request, in the context of legal proceedings or investigations and requests for information from the authorities or in order to comply with other legal obligations. Your personal data can be consulted by MMV teams within the framework of the service provided by MMV and the commercial relationship that binds us.

The data transferred to third parties will only be used for the purposes of the service purchased and provided, in particular:

  • • Payment companies allowing the payment of stays and services and facilitating the fight against fraud,
  • • Trusted partners (identified on our website) who offer related products and services on our website or from our Booking Centre (typically if you purchase products and services offered on our websites by third parties such as Allianz Travail, Assurinco, Skiset or the companies providing lift passes). You may be a customer of MMV and these third parties, and we and our partners may collect and share information about you, such as your contact and billing information. The data transmitted to these third parties will not be used for commercial purposes by the partners once the service has been completed. MMV is however not responsible for the use of your personal data by third parties where such use is permitted for their own purposes. We invite you to consult the privacy policies of the third party companies with whom you have subscribed for additional services (insurance, ski lifts...) for more information ;
  • You may be able to access third party online chat services or social media services from our website or mobile application or before visiting our website or application. When you register with your social network account, we collect the personal information you choose to share with us through these social media services in accordance with their privacy settings in order to enhance and personalize your use of our website or mobile application. We may also use social media plug-ins on our website or mobile application. As a result, your information will be shared with your social media provider and may be presented on your social media profile for the purpose of sharing with others on your network. MMV has endeavoured to implement reasonable precautions to preserve the confidentiality and security of the personal data processed and to prevent it from being distorted, damaged, destroyed or accessed by unauthorised third parties. Technical and organisational security measures have been put in place to this end.

5 - How do we use your data?

The personal data collected is used for the following purposes:

  • • Proposing hotel stay offers to the consumer
  • • Propose offers of services related to the stay (packages, equipment…)
  • • Indirect sale of hotel stays through intermediary networks
  • • Management of hotel stays sold by other hotel groups
  • • Providing after-sales service for booked stays and handling complaints
  • • Organize sales events and marketing operations to inform you of the offers we make available to you, new destinations and services
  • • Analyzing the use of offers and services to improve your customer experience (visiting the website, handling your calls, managing requests for quotes…)
  • • Survey customers (such as the satisfaction survey)
  • • Improve offers and customer relations and give you access to certain features of the site or our application (online check-in, access to your customer account, payment of your balance at the end of your stay…)
  • • Ensuring the security of platforms and services
  • • Fighting fraud

MMV shall not process such data in a way incompatible with those purposes. Your data is kept for the time necessary to fulfil the purposes mentioned above.

MMV also processes your data to meet its legal or regulatory obligations.

Your data may be kept for as long as necessary to enable MMV to meet its legal obligations.

Promotional, commercial and marketing processing :

After obtaining your prior consent (unless MMV has lawfully obtained data by processing via a medium to which you have already specifically consented for promotional, sales and marketing purposes, including disclosure to third parties), data processing will take place for the purpose of achieving the sales and promotional objectives of our activities as well as for the execution of the contract. The absence of consent for these purposes will not allow you to receive commercial offers, discounts and/or commercial communications. MMV emphasizes that without your explicit consent your data will not be communicated to third parties for promotional and marketing purposes.

After obtaining your consent, your data may be used for sending commercial communications (marketing) and / or direct sales on its own initiative or that of its partners, by email, fax, telephone, web push notifications and all other remote communication technologies - including communications via social networks. Consent to data processing for these purposes is absolutely optional.

Even if you decide to consent to the processing of data for the purposes specified here, you nevertheless retain the right to object, in whole or in part, by simply sending a request to MMV at the address indicated in point 9.

Disclosure to third parties for promotional, commercial and marketing purposes. Within the framework of the execution of the contract MMV may be led to provide your data to its subcontractors (ski equipment rental companies, ski lift management companies etc.). Your data will then only be used for the execution of the contract and may not be used for promotional purposes by the third party subcontractor.

6 - How long do we keep your data?

MMV keeps your data for as long as necessary for the purposes of processing. You may at any time unsubscribe from our one-click commercial solicitation emails or direct marketing campaigns by writing to dpo@mmv.fr

Once you have unsubscribed and although we no longer use your data for promotional or commercial purposes, we nevertheless keep your email address to ensure that we do not retrieve your details in the event of a new collection operation via a partner. If you would like us to delete all your information you can write to us at dpo@mmv.fr. After cancellation, the data will be anonymised and archived.

7 - Cookies and tracking on the site

Our website uses cookies to enhance your experience and provide certain features that may be useful to you. This may include cookies from media and advertising partners that are placed on your computer when you visit our website or Application. These cookies allow us to identify your connection terminal or the pages you visit and are generally anonymous and not sufficient on their own to identify you personally.

This is information that is not obtained to be associated with identified stakeholders, but by its nature and through elaborations and associations with data held by third parties, which could allow the identification of users. We use tracking software to monitor customer traffic patterns and site usage to help us develop website design and layout. This software does not allow us to capture personal information and is anonymous.

8 - Are your data processed outside the EU?

MMV does not allow the transfer of any data provided by the User/Customer, except in the express case where the latter exercises his right to data portability and gives written instructions to MMV to this effect.

9 - What are your data protection rights and remedies?

For each specific processing of personal data that we collect from you, we will inform you whether the provision of personal data is legally obligatory or necessary to conclude a contract and what are the possible consequences if you choose not to provide it. You have the right to access, rectify and delete data concerning you. You can ask for the portability of these last ones. You also have the right to object to the processing carried out or to ask for it to be limited.

Specific rule for telephone canvassing: any consumer may register free of charge on an opposition list called "Bloctel" in order to no longer be canvassed by telephone by a professional with whom he has no current contractual relationship. Right of access:

Right of portability:

When MMV processes your personal data by automated means in accordance with your consent or agreement, you have the right to obtain a copy of your data transferred to you or another party in a structured and current format. This applies only to the personal data you have provided to us.

Right of rectification:

You have the right to request the correction of your personal data if it is inaccurate, including the completion of incomplete personal data.

If you have an MMV account, you can change your personal data on your account or member pages.

Right of deletion:

You have the right to delete any personal data processed by MMV at any time, except in the following situations:

  • • you have an ongoing matter with Customer Service
  • • you have a reservation in progress for a stay not yet made
  • • you have debts with MMV, regardless of the method of payment
  • • you are suspected of having or have used our services fraudulently in the last four years
  • • your debts have been sold to a third party within the last three years or within the last year for deceased customers
  • • if you have made a reservation, we will keep your personal data in connection with your transaction for accounting purposes, in accordance with regulations

Right of opposition:

You have the right to object to the processing of your personal data on the basis of a legitimate interest of MMV. MMV will cease using your personal data unless we prove that the use of your data supersedes your interest and rights or for legal reasons.

Right of restraint:

You have the right to request that MMV restrict the use of your personal data under the following circumstances:

  • • if you object to the processing of your data on the basis of a legitimate interest of MMV, MMV will limit the processing of such data while verifying the legitimate interest
  • • if you declare that your personal data are inaccurate, MMV shall limit the processing of such data pending verification of the accuracy of the personal data
  • • if the processing is unlawful, you may object to the deletion of the personal data and request the limitation of the use of your personal data
  • • if MMV no longer needs the personal data but it is necessary for the defence of a right in court.

How to exercise your rights?

We take data protection very seriously and therefore have an address dedicated to handling your requests related to your personal data. You can contact the service at dpo@mmv.fr.

To exercise your right to oppose direct marketing, you can unsubscribe from marketing campaigns:

  • • by clicking on the unsubscribe links in our emails
  • • by modifying your preferences in your MMV account
  • • by writing to donnees.personnelles@mmv.fr

Even after we have stopped sending you our marketing communications or communications on behalf of a third party, we may continue to retain your data to demonstrate consent for all communications made up to the time you request cancellation. We will not share this information with anyone except as permitted by law.

If you receive our communications on the basis of a contractual relationship with MMV, we will only cancel your data when that relationship is terminated and/or as provided for in the contract and applicable law. Finally, if the e-mail sending systems encounter problems when delivering communications to your e-mail address or if your account is inactive for a long period of time, the Company MMV may request the cancellation of your data after a period of 18 months since your last activity. After cancellation, the data will be archived.

Any request to exercise your rights of deletion, restrictions other than the one described above concerning promotion and direct marketing operations must be accompanied by a photocopy of a proof of identity (national identity card issued by the French State or other Member State or European Union identity card or passport, residence card issued by the French State or other Member State, residence permit issued by the French State or other Member State or traffic book issued by the French State or other Member State). A reply will be sent to you within one month of receipt of your application.

If you feel that MMV is using your personal data inappropriately, you may contact us. You also have the right to lodge a complaint with the Data Protection Officer (DPO).

10 - Data Protection Officer (DPO) :

In accordance with the rules of the GDPR (EU Regulation No. 679/2016), we have appointed a Data Protection Officer (DPO) who will ensure that your personal data is systematically used in a transparent, accurate and lawful manner.

The MMV company has appointed as Data Protection Officer: Maître Odile DUSSART, Data Protection Officer and Lawyer at the DRAGUIGNAN Bar 95, Avenue Victor Hugo 83700 Saint Raphael - France. If your exchanges with MMV have not been satisfactory, you have the possibility to file a complaint with the Commission Nationale de l'Informatique et des Libertés (CNIL), the supervisory authority in charge of compliance with personal data obligations in France.

11 – How is your data secured?

MMV makes sure that your data is treated securely and confidentially, including when certain operations are carried out by subcontractors. To this end, the appropriate technical and organisational measures to prevent the loss, misuse, alteration and deletion of your personal data are put in place. These measures are adapted according to the level of sensitivity of the data processed and according to the level of risk presented by the processing or its implementation.

12 - Changes to our Privacy Policy:

This Privacy Policy may need to be updated according to changes in French and European legislation. The latest version of the Privacy Policy is always available on our site. We will notify you of any changes to the Privacy Policy, including, for example, the purpose of the use of your personal data, the identity of the Controller or your rights.
